WebIn a Nutshell: Character evidence is generally inadmissible to prove specific conduct in the past, however, when a witness unexpectedly testifies about a general character trait, the prosecutor is free to cross-examine that character evidence because the witness “opened the door” to allow such cross-examination. WebThe “opening the door” theory must necessarily be approached on a case-by-case basis. As a result, this principle is not readily amenable to any prescribed set of rules. (See McCormick, Evidence [2d ed], § 57.) Nonetheless, it does have its limitations.
